2. General

We want you to appreciate and enjoy your Elecosy products. Should you have questions, please do not hesitate to contact us at info@elecosy.com.

3. Currency

All prices are in € and include the current rate of Belgian VAT. Deliveries to VAT registered customers outside Belgium will be without VAT, provided the customer’s VAT number is supplied in advance.

4. Delivery information

We have different delivery prices for different EU countries. Details are available on our website. We intend to dispatch all orders within a maximum of 7 working days from receipt of order. However, should your order be out of stock or have to be specially made for you, we will immediately inform you of a new delivery date, giving you the opportunity to decide whether to wait for or change your order.
Orders outside the EU are subject to different delivery prices and are available upon request. All overseas taxes are the responsibility of the buyer.

5. Secure payments

To ensure your credit card payments are secure, our payment page will take you to the Belgian PayPal server to process your payment and then redirect you back to our website. Unfortunately, we are only able to accept credit or debit card payments.

6. Returns and refunds

We make every effort to ensure that all colours are well represented on our website.  However, be aware that all our products are handmade and that the paperbase is made using natural fibers from elephant dung and can vary according to their diet. Therefore the colours and the texture of our goods may appear to be slightly different from what is shown on our website or other marketing materials.

In the event that you would still wish to return any goods you received, you can do this within 7 days after receipt, by notifying us in writing and returning the goods at your expense. The goods must be in their original packaging.  We aim to credit you within 30 days.
Orders that are specially made cannot be returned.

7. Damaged items

Although we make every effort to ensure products arrive in good condition, there may be times when goods are damaged in transit. In this case, we will arrange for a replacement, or a full or partial refund. Please contact us at info@elecosy.com within 3 days of receipt of the goods to advise us of the damage. It could also be a help for us to assess the damage if you could send us a picture of the damaged goods.

8. Intellectual property

Elecosy is a member of ACID (Anti-copying in design).
All intellectual property rights in our designs and products and in the images, text and design of this website are and will remain the property of Elecosy BV.
You may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, display, or in any way exploit any or any part of this website, including text and/or images or any combination thereof, in whole or in part, except as may be expressly permitted by Elecosy BV.

9. Force majeure

We are not liable for any breach of our obligations resulting from causes beyond our reasonable control, such as (but not limited to) war, strike, riot, crime, acts of God.

10. Liability limitation

These terms set out the full extent of Elecosy BV’s obligations and liabilities in respect of the supply of or failure to supply products. Elecosy is not liable to you or any other parties :

1. for any indirect, incidental, consequential, punitive or exemplary damages, or for loss of income, profits, bargain, revenue, contracts, good will, use, enjoyment, time, data, electronically transmitted orders or other economic advantage ( but not to the extent that applicable law prohibits liability exclusions or limitations for intentional torts, gross negligence, damages arising out of product liability or other fault basis), except in the event of damages that result from Elecosy’s gross negligence or intent as well as in the event of life dangers and bodily injuries. The liability according to the product liability law remains ineffective.

2. Elecosy shall be under no liability in respect of any defect arising from fair, wear and tear, or any willful damage, negligence, subjection to abnormal conditions, failure to follow the Elecosy instructions (whether oral or in writing), misuse or alteration of the goods, or any other act or omission on the part of the customer, its employees or agents or any third party.

3. Except as expressly provided in these conditions, Elecosy shall not be liable to the customer by reason of any representation, or any inclined warranty, condition, or other term or any duty at common law or under statute or under the expressed terms of the contract, for any direct or consequential loss or damage sustained by the buyer (including without limitation, loss of profit or indirect or special loss), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of Elecosy, its servants or agents or otherwise) which arise out of or in connection with the supply of the goods or their use by the customer.

4. The customer shall ensure that except to the extent that instructions as to the use or sale of the goods are contained in the packaging or labelling of the goods, any use or sale of the goods by the customer is in compliance with all applicable statutory and other regulatory requirements and that the storage and handling of the goods by the customer is carried out in accordance with directions given by Elecosy or any competent governmental or regulatory authority and the customer will indemnify Elecosy against any liability, loss or damage which Elecosy might suffer as a result of the buyer’s failure to comply with this condition.

Under no circumstances will Elecosy’s liability exceed the contract price for the products claimed to be defective.

11. Acceptance

Any queries relating to the above should be raised before taking delivery of your order or it is deemed you have accepted these terms and conditions. This does not affect your statutory rights.

12. Change of terms

Elecosy BV may amend these terms without prior notice.
